Thank you so much for sharing this! I got a loan from Santander in January 2016. My car got repossessed in December 2016. I’m pretty sure I qualify for loan forgiveness. Paying $425 per month for a 2010 car! I’m paying 25% interest! Santander sent me an offer to modify the loan instead of loan forgiveness! The loan modification will not help and it will take longer to pay until 2025!!! I haven’t received anything from Santander yet!!! 🙄

I bought a new car in 2014 and in 2015 I was in an accident that wasn’t my fault but the other person’s insurance didn’t pay off my car and they are trying to make me pay. It just doesn’t seem right to me. I’m losing out big time because it’s on my credit report and I don’t have my car either.

Santander modified my loan last year before I knew about the class action lawsuit. I was behind and was trying to make arrangements with them to keep the vehicle. They reduced my principal balance by 6k and reduced my APR from 26% to 4% they reduced my payments by 200$ a month roughly, but did extend my loan by 24 months. Now I find about about the lawsuit and this underhanded process. I was not aware or told about the lawsuit when my modification was done, now I fear I may have forfeited any settlement from santander.

Hi everyone. I just received my title in the mail from Santander yesterday (8/31/20). Short story. I defaulted on my loan a year ago (April 2019) and they charged-off my account. I called in Aug (2019) and brought my payments current but it was still a charge-off. After making on-time payments on a charged-off account for a yr straight, I was able to keep the car. Last month (August 2020) I went to go make a payment ($504) on my balance ($12,495), I seen that it said, "–". So I went to check my transactions history and it showed a deduction of the entire amount! Confused… So I tried calling them and every time I put in my account information, it would say "you don't have an account with us". I got nervous and then googled the company. Low and behold, I seen there was a settlement! Jackpot… I logged into my account and in the "message" box, I sent a request asking for them to mail my title. Within 2 weeks later, I received a letter from Santander saying "You have satisfied your loan and enclosed is your lien released title"! Thank You LORD! You don't have to do any of that credit b.s. like requesting someone draft you "demand letter and or contacting the AG". If you qualify, they'll reach out to you sooner or later. Continue to check the website they provided or keep calling Santander. Trust, they'll get tired of you calling and just close your account out, paid and full just to get rid of you… Lol -Don't waste your money on these "trying to get extra income" dudes demand letters because they can't do anything you can't do! Believe me! I hope you all get what's owed to you from these crooks!

A month ago I didnt know about the lawsuit and I was in bad shape on my loan. I've been making payments since 2014 They all of a sudden told me that I can refinance. I signed it And now I hear this news. Does that mean I won't be able to benefit from this 😪

This is what Santander do. After the duration of the loan, they said still owed $8,000 BS! They have done this to countless people. They have predatory loan practices. I am so glad that something is finally being done. We tried to Sue them but their lawyers are good, they had that loophole you just read to get out if it. In order to deferr a payment, that's what they did. Crooks!!!

I called Santander to request a refinance on the car loan, and It's actually called a remodification, and they do not refinance their own loans.

Question. I got a letter and offer / pre-aprved to refinance my car with open road lending. Is open road lending associated with santander? And do I loose my rights to a potential settlement if I refinance my car with Open Road lending? They want to cut my interest in half. From 20% to 10%. This letter looks similar to the one in this video.

I sent Santander/Chrysler Capitol a demand letter for my title last week. Ive been in default for over a year and still have the truck.(long story)Ive had no calls in a year, and since the letter, they just started calling.Im assuming since they have resumed calling, they want to offer me some bogus deal. I can no longer drive it, because they have the title and i cant tag it. I just want my title.

I received a letter from state attorney but I refinanced and pretty much have the same payment. I’m really behind on payments but will I still benefit from this settlement? I was with Santander almost two years

A couple of days ago, Santander called me and asked me about refinancing my remaining loan amount. The car was repossessed in January 2020. I felt the reason they called me was because they knew I was a qualified participant of their lawsuit/settlement. I took the name and badge number of the customer service rep that called me, which she reluctantly gave me. She was rude and hung up on me when I let her know that I was aware of what was going on with Santander. I submitted a complaint to my Attorney General here in Illinois and included the name and badge number of the rude CSR. Did I do the right thing and is there something more I could do?

I've been listening to all the vids but I'm still confused on my situation and hoping creditrepairshop or anybody can chime in on this –
    1) I've been paying on my loan since 2015 and STILL owe just under 5K jeez!!
    2) My loan used to be with Gateway Lending but it was sold to Santander March of this year AND (I think this is super SHADY), I had been OVERPAYING every month to Gateway but as soon as it sold to Santander my payments dropped to the minimum payment amount without anyone informing me… this is actually how I found out my loan had been sold because I noticed a drop in payment on my bank transactions, not anyone from EITHER loan company informing me!
    3) I've never missed a payment or had to deal with any repos but suddenly I cannot get into my contract online with Santander. I feel like I used to be able to see it online.
    4) I've lost my job over a month ago and have $0 income, have yet to see ONE unemployment payment
    5) I just had an online chat just to enquire about deferment and rep told me IF I were approved for deferment, the payment gets placed at the end of the loan and that monthly payments go to Interest FIRST then remaining goes to principal…. is this legit?
    6) I had to formally request a mailed copy of my contract, rep said it is unavailable online because of sensitive info…. yet I used to be able to see it np.

WHAT IS UP WITH THESE SHADY SH!TS!!

Does my situation seem shady to you, and what should I do next?? Is it smart to defer or should I just keep current? Do I perhaps qualify for settlement even without a repo??

    Any help is SO appreciated!!

I had a santander loan. I purchased an extended bumper to bumper warranty with the purchase of my car. the transmission went out six months into the loan and they refused to honor my warranty. I took the vehicle back to the dealer to get serviced and it was repoed! I wasn't even behind on payments. That was three years ago. I now have a repo on my credit and they are saying that I'm still obligated to pay and they wont remove this derogatory item off of my credit

STOP DEMAND LETTERS THAT IS NOT GNG TO WORK TAKE ACTION. TAKE THEM TO COURT. DEMAND LETTERS NOT GNG TO WORK I SENT LIKE 4. All they do is send me a copy of contract I removed it from transunion. Now where I may have a chance to remove from other bureaus is my contract is a 60 month term. But they have it on bureaus as a 70 month term I’m banking on that to have it removed from credit. Even though I still will make payments. But remove from credit bureau continue making payments till they settle with us. But demand letters not going to work

Is there a class action suit or provision in the suit for predatory lending on lemon vehicles? I voluntarily returned an SUV to Santander because after I bought it, put $1500 in tires and repairs on it, it started running hot and I couldn't drive it. It actually sat in my job parking lot for 3 months. I was SUPPOSED to have some kind of warranty in the contract they said could have repaired the car. (Which they only told me about AFTER they picked up the vehicle.) Oh, and the only reason they came and got it was because I told them if they didn't get it, my boss was going to start charging them $100/day storage. It was gone the next day.

Scamtander doing what they do best!!! It's sad that some people will fall for their evil tactics unfortunately. For me I just want to get them to remove the repo off my credit. I've sent 3 letters with no response so I can be sending one more and if they don't remove it I'm going to the bureaus

Santander has sent my account to a collection agency. My car was/is in repo status and has been for years, but I still have the car. I believe that I am entitled to a settlement based on much of the criteria. This is on my credit reports. How should I handle this since the collection agency is involved?

I have gone to the website and it redirects me and basically refreshes the page, how do I get my name into this lawsuit? I have emailed the lawyers as well and have received no response.

  39. 2Tynia
    July 29, 2021 at 7:29 pm

Shouldn't the credit bureaus be on alert to what Santander is doing, the Attorney Generals that file the lawsuit should have the courts put an injunction against them to stop any credit bureau reporting since the inception of this lawsuit. WHY CAN'T WE DO SOMETHING ABOUT THIS….I feel so powerless!

  40. 2Tynia
    July 29, 2021 at 7:29 pm

I would negotiate with them, mostly because if you do the math on your payment history (for those that had their contract with Santander longer than a year) you've probably paid for that car 3x over!

I got a call this evening from Santander offering me a modification when I was previously told there were no refinancing options. So my question is how do I know if I may be eligible for the settlement and possibly have my balance forgiven and receive my title? Can I call my Attorney General? I’m in Georgia.
